Terms of Service

These Terms of Service ("Terms") govern your use of TorqueAI (the "Service"). By signing up for or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TorqueAI provides an AI chat assistant that answers customer questions and captures appointment requests ("leads"). It comes in two forms, and which one you use decides which sections below apply to you:

• The website widget — a snippet you add to your own website. Captured leads are emailed to you. This is the paid subscription described in sections 4 and 5.
• The GoHighLevel marketplace app — described in section 1a. It is free of charge.

Features may change over time as we improve the Service.

1a. The GoHighLevel marketplace app

• There is no charge for it. The app is listed as free in the GoHighLevel marketplace, there is no trial to expire, and no payment method is collected for it. Sections 4 and 5 (billing, renewal and cancellation) do not apply to it. If we ever introduce a price, it will apply only to installs made after that change is published.
• What it does. Once installed on a sub-account or across an agency, it answers inbound customer messages in that sub-account's GoHighLevel conversations and writes each captured lead as a note on the customer's contact record. It does not send a separate email or text alert, does not start conversations, does not send bulk messages, and cannot book appointments.
• Where it stands down. It ignores messages your own team sends, and stays out of any conversation a human has replied in for 24 hours. Each shop has an on/off switch on its settings page, and uninstalling the app from GoHighLevel stops it entirely.
• Your responsibilities. You are responsible for installing it only on accounts you own or are authorized to manage, for the shop details you configure, for following up with the leads it captures, and for keeping your settings link private — anyone holding that link can change that shop's settings.
• Fair use. Each location is capped at 200 AI replies per day as a cost guard. We may contact you before changing that limit.

2. Eligibility

You must be at least 18 years old and authorized to enter into these Terms on behalf of the business you represent.

3. Your account and setup

• You are responsible for the accuracy of the information you provide and for keeping your private setup link secure.
• You are responsible for adding the provided code snippet to a website you own or are authorized to manage — or, for the GoHighLevel app, for installing it only on accounts you own or are authorized to manage.
• You are responsible for the shop details and instructions you configure, and for following up with the leads you receive.

4. Free trial, billing, and renewal (website widget only — the GoHighLevel app is free)

• New subscriptions include a 30-day free trial. You provide a payment method at signup but are not charged during the trial.
• Unless you cancel before the trial ends, your subscription automatically begins at $99 per month and renews monthly until cancelled.
• Fees are billed in advance, are stated in U.S. dollars, and are non-refundable except where required by law.
• Payments are processed by Stripe and are also subject to Stripe's terms.

5. Cancellation (website widget only — uninstall the GoHighLevel app from the marketplace and nothing is owed)

You can cancel at any time through your Stripe billing portal or by emailing [email protected]. If you cancel before day 30, you will not be charged. If you cancel after billing begins, your subscription remains active through the end of the current paid period and is not renewed afterward.

6. Acceptable use

You agree not to use the Service to: break the law; send spam or harassing messages; impersonate others; infringe intellectual property; transmit malware; or attempt to disrupt, overload, or gain unauthorized access to the Service.

7. AI-generated responses

The assistant's responses are generated automatically by an AI model and may occasionally be inaccurate, incomplete, or unexpected. The assistant does not provide professional, legal, financial, or mechanical advice. You are responsible for reviewing leads and communicating directly with your customers. We do not guarantee any specific number of leads, conversions, revenue, or business results.

8. Availability

We work to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or reasons outside our control.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, TorqueAI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months before the claim arose.

11. Indemnification

You agree to indemnify and hold TorqueAI harmless from claims, losses, and expenses arising out of your use of the Service, your content and configuration, your communications with your customers, or your violation of these Terms or applicable law.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-laws rules. Any dispute relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
